These Terms and Conditions govern your access to and use of the hovee Rent platform (Platform or App), operated by Shersi Communication Private Limited, a company incorporated under the Companies Act, 2013 with its registered office at:

By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.

1. Platform Overview

hovee Rent is an online platform facilitating the listing, discovery, and renting of residential, commercial, and PG accommodations in India. The platform connects verified property owners and managers directly with potential tenants, excluding brokers and agents

Owner profiles are reasonably verified based on the documents submitted by them (such as electricity bill, phone bill, property tax receipt, gas bill, etc.). Verification is limited to document review, and no physical inspection or independent verification is conducted unless specifically stated

2. User Eligibility and Account Registration

  • Users must sign up to list or rent properties.
  • Sign-up requires: Name, Email, Phone Number, address of user
  • Users must be 18 years or older to register.
  • Identity verification may be required during sensitive account changes or if flagged for suspicious activity.
  • Only verified ownersProperties or self declaredauthorized property managers may list properties.

Responsibility of user

  • You are responsible for keeping your account credentials, device, and sensitive information secure.
  • You are responsible for all activities that take place under your user account.
  • You must inform us immediately of any unauthorized use of your account via email.

3. Listings and Content

Required Information for Listings:

  • Property Type (Residential/Commercial/PG)
  • Location & Address
  • Images
  • Rental Terms
  • Proof of Ownership or self declaredAuthorizationwith proof of property
  • Proof of ownership, or a self-declaration of authorization along with available property-related documents (such as EB, tax receipt, etc.)

Review:

All listings undergo a manual and digital review process (In future might be involved through API services or Artificial Intellegence services, how to cover this now???). Any listing found to be misleading, fraudulent, or in violation of these Terms will be removed without notice

4. Prohibited Activities

Users must not engage in:

  • Fraudulent activities
  • Harassment, abuse, stalking, defamation
  • Spamming or posting misleading or duplicate property content
  • Impersonation or misrepresentation
  • Uploading illegal, offensive, obscene, or infringing materials

'hovee Rent' reserves the right to suspend or permanently ban any account found violating these rules.

5. Payments & Subscriptions

  • Users can access premium features through paid subscription plans (Basic, Plus, Premium).
  • Payments are processed through third-party gateways.
  • 'hovee Rent' is not liable for any payment delays or refund issues arising from these gateways.

Disclaimer: Refunds (in cases of failed transactions or technical errors) may take up to 15 working days and are subject to the terms and processing policies of the third-party payment provider.

6. Privacy & Data Use

We collect and process the following personal data:

  • Name, Email, Phone Number, Date of Birth
  • Address, ID Proof, and Property Ownership Proof

We do not sell your data.
We may share limited data with trusted third-party service providers to enable service delivery.

7. Disputes Between Users

Definition:

A User Dispute refers to any disagreement, complaint, or concern raised by one user against another, which may include but is not limited to:

  • Misrepresentation of property
  • Fraudulent listings
  • Harassment or misconduct
  • Unauthorized use of property images or information
  • Ratings on both parties involved in tenancy for their services, with an option for users to dispute a rating if they believe it is inaccurate or unfair

hovee Rent will investigate and take appropriate action.

In serious cases (fraud, impersonation, criminal activity), we may:

  • Cooperate with law enforcement agencies
  • Initiate legal proceedings under applicable Indian laws

8. Account Termination & Deletion

hovee Rent reserves the right to suspend or terminate accounts involved in:

  • Fraud, abuse, or repeated violations
  • Uploading inappropriate content
  • Unauthorized activities on behalf of others

9. Dispute Resolution, Arbitration, and Jurisdiction

In the event of any dispute, difference, or claim arising out of or relating to this Policy or the use of the platform, the parties shall first attempt to resolve the matter amicably through mutual discussions.

If the dispute remains unresolved within thirty (30) days, any civil or commercial dispute arising under this Policy shall be referred to and finally settled by arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time. The arbitration shall be conducted by a sole arbitrator, mutually appointed by the parties. The seat and venue of arbitration shall be Chennai, and the proceedings shall be conducted in the English language. The arbitral award shall be final and binding on both parties.

Notwithstanding the foregoing, any dispute involving criminal offences, data breaches amounting to statutory violations, or matters requiring intervention of governmental or regulatory authorities (including but not limited to the Data Protection Board of India, CERT-In, or law enforcement agencies) shall not be subject to arbitration and shall fall under the exclusive jurisdiction of the competent courts and authorities in Chennai, India.

Each party shall bear its own costs of arbitration, and the arbitrator's fees shall be shared equally unless otherwise determined in the award.

10.Intellectual Property

All content, features, functionality, designs, graphics, text, logos, trademarks, and other materials displayed on or through the app, including Hovee and the Hovee Logo, are the exclusive property of Shersi Communications Pvt. Ltd. or its licensors and are protected by applicable intellectual property laws.

You may not copy, modify, distribute, display, reproduce, or create derivative works of any part of the app or its content without prior written permission from Shersi Communications Pvt. Ltd.

By using the app, you acknowledge and agree that all intellectual property rights in the app and its content remain with Shersi Communications Pvt. Ltd., and nothing in these Terms grants you any ownership rights.

11. Limitation of Liability

hovee Rent and Shersi Communication Pvt Ltd shall not be liable for:

  • User-posted content or data accuracy
  • Payment gateway failures or delays
  • Disputes between property owners and tenants related services provided and the voluntary final ratings assigned to those services
  • Service interruptions or technical issues
  • Any loss or damage caused due to unauthorized access or use of your account

12. Force Majeure

hovee Rent / Shersi Communication Pvt. Ltd. shall not be liable for any failure, delay, or interruption in the performance of its obligations caused by events beyond its reasonable control (Force Majeure Events). These events include, but are not limited to:

  • Changes in laws, regulations, or government policies that impact or restrict digital rental operations.
  • Government-imposed lockdowns, restrictions, or internet shutdowns.
  • Cyber-attacks, system breaches, or major technical failures rendering the platform inoperable.
  • Natural disasters, fires, floods, earthquakes, epidemics, pandemics, or other acts of nature.
  • War, riots, strikes, labour disputes, or civil disturbances.
  • Any other event that is unforeseeable, unavoidable, and makes performance impossible or illegal.

During a Force Majeure Event, the company's obligations shall be suspended to the extent affected. The company will make reasonable efforts to resume operations as soon as practicable once the event concludes.

13. Response Timelines

We strive to respond to user requests such as technical issues, support queries, verification-related requests, payment-related concerns, and extension requests within a reasonable processing timeframe. Certain service categories may require additional time, and any extended timelines will be communicated to the user through available channels.Some request types, including tenancy-related queries and mutual ratings, may not have fixed response timelines. All response efforts are subject to the user's active subscription status.

15. Changes to Terms

We reserve the right to modify or update these Terms at any time. Changes will be notified via email or app notifications.

We reserve the right to modify or update 'hovee Rent' application software at any time for the continuous improvement and bug fix. Major changes to the application will be notified via email or app notifications at sole discretion by the company.
